Booking Conditions

These terms and conditions apply to Yachtsun Sailing & Island Holidays. Yachtsun are retail agents for Sunvil Sailing Holidays, for these holidays Sunvil Terms & Conditions apply (details can be found in the Sunvil brochure or will be supplied upon request).

Booking

Provisional bookings will be considered cancelled if not confirmed within 7 days. A yacht/holiday is not booked until the completed booking form, together with 30% of the charter fee has been received. In paying your deposit, you are deemed to have read and accepted the following terms and conditions and other information relevant to your holiday shown in brochures or on the Yachtsun website.

Yacht Details

Yacht details are given as a general guide, whilst every effort is taken to ensure details are correct, it is always advisable to check specific features and equipment when booking.

Payment

The balance of the charter/holiday fee must be paid to us eight weeks before the commencement of the charter/holiday period.

Security Deposit

A security deposit is required (amount shown on price lists), this is the limit of your liability for loss or damage to the yacht, and to third party, equipment, official papers, or to and any expenses incurred if the yacht is returned late. This is refunded at the end of the charter less any deductions for damage or losses. In some locations you may opt to insure your deposit with a non-refundable premium or damage waver. The deposit or the waver does not cover any acts of gross negligence, wilful damage, night sailing, sailing under the influence of alcohol or drugs and loss of your dinghy may not be covered in some locations.

Extras

There is a charge for yacht cleaning and fuel, this must be paid, on site, in the local currency.

Safety

In booking this holiday, you accept that sailing holidays contain an element of risk and participation in this activity is your decision. The skipper is responsible for the safety of the vessel and its crew at all times.

Yacht Insurance

The yachts Marine Insurance covers third party and passenger liability for yachts charter.

Travel Insurance

It is a condition of booking that all members of the party must have adequate travel insurance, at least to the level offered by Global Travel Insurance

Exemptions From Liability

We take great care to see that our yachts meet local regulations and maintain the highest possible standards. We cannot be held responsible for any non-fulfilment of program: illness: injury or death however caused unless, we or any of our employees are proved to be negligent.

Cancellation by the Charterer

Should the client be unable to take the holiday or yacht charter, we must be notified immediately in writing and every effort will be made to re-book the holiday or charter. If we are successful, we will refund the monies paid, less any expenses incurred in re-chartering. If we are unable to re-book the holiday or charter the yacht, the charterer remains responsible for the whole amount due.

Cancellation By yachtsun

In the unlikely event of our being unable to make the yacht or holiday available, we will inform you as soon as possible and offer the following options.
a) If available, a change of yacht to one of comparable size and value.
b) Cancellation and refund of all monies paid for the yacht charter / Accommodation

Yachtsun Rights

We reserve the right for Yachtsun or persons managing charters at the various locations to control or limit sailing activities according to local conditions or assessment of the skippers experience and ability.

Chartering

Embarkation time is normally 17:00 hrs; you are required to check into the yacht base at the end of your holiday by 17:00 hrs on the evening before departure. Disembarkation is normally at 09:00 hrs. The time taken to familiarise you with the yacht together with completion of any formalities required by the Port and Customs authorities is part of the agreed charter time. You will be granted free use of the yacht after you have accepted the yacht and therefore take over full responsibility, and you will have no rights to claim for any loss of time or expense caused by any accident, breakdown or failure of any part of the yacht. However, such acceptance does not imply that you assume responsibility for any failure, damage, loss or expense due to normal wear and tear or defects that are agreed and noted on you taking over the yacht. In the event of failure of the engine or any other important equipment or should any other matters for concern arise, you must notify the Yacht Base or appointed Emergency Service at the earliest practical opportunity. Arrangements will be made for repairs to be carried out, should this take longer than 48 hours you will be offered an alternative yacht or provided with accommodation, or refund of the proportion of the charter not used. The skipper must take full responsibility for the conduct of himself and all the members of the crew/party. We reserve the right for the persons managing your charter at the various locations to terminate the client’s charter of any client who refuses to comply with the instructions, if behaviour of the client is likely to cause distress, damage or danger. No one in the party should commit an act contrary to the laws of the destination country, should this happen the agreement between us will automatically terminate, but without prejudice to our rights. You and/or your party will carry full responsibility and answer to the appropriate Authority.

Accidents

The skipper is responsible for the safe navigation of the yacht at all times. We must be informed immediately in the case of accidents and the skipper must furnish us with a full written report, giving full particulars together with names and addresses of witnesses.

Repair

Major repairs are our responsibility, unless made necessary by the charterer's negligence. We must be notified immediately if any repairs become necessary and they must not be carried out without prior authority from us.

Cruising Limits (Greece)

Yachts are restricted to the area bounded by Corfu in the North Zakynthos (Zante) in the South and the Corinth canal in the East. Yachts from the Armonia Pontoon are restricted to the area South of the Levkas canal, between Levkas, Kephallonia and the adjacent mainland.

Complaints Procedure

Yachtsun aim to provide you with the best possible holiday and one that meets your expectations. However if a problem occurs you must report this immediately (or as soon as it is possible) to the yacht base manager or Hotel/Accommodation owner who will try to resolve this on the spot. However if you are not satisfied, you should make them aware of your dissatisfaction and write to us as soon as possible, but not later than 28 days after your holiday. Complaints regarding extra goods or services paid for on site must be reported on site as they can only be resolved/refunded where the purchase was made.
